Supreme Court Declines To Refer Faruqui Case To Larger Bench; Justice Nazeer Dissents | Breaking

The Hon'ble Supreme Court of India today declined to refer the Ismail Faruqui case to a larger bench via a split decision 2:1. Chief Justice Dipak Misra and Justice Ashok Bhushan gave a separate verdict while Justice Abdul Nazeer dissented with the rest and pronounced his own verdict. Justice Misra and Justice Bhushan declared in their verdict that the case need not be referred to a larger bench while upholding the 1994 judgement. Meanwhile, Justice Abdul Nazeer held a different view from the others and pronounced that the 1994 verdict was declared without a comprehensive examination of the issue. He further stated in his judgement that the case should be referred to a larger bench. On the other hand, the Supreme Court articulated that the Farooqui case will not affect the title suit which is the Babri Masjid case and the hearing of the latter will begin on October 29. The Babri Masjid case will be viewed as a land dispute as stated earlier, the judgement read.
